THE QUESTION

There has been a whirlwind of legislation in America over the past ten years; statutes which both add to and convolute our already oppressive society. So, I figured a little insight into living under these laws might be timely. There are so many, so I’ll just address what I think are the most pointed.

After September 11th, pretty much that hallmark date that the government chose to institute such sweeping change, the right to speak out against government pretty much equated to speaking for terrorism. I mean come on now. Don’t you see the nexus?  Homeland Security does!

Then with this Patriot Act (Can’t imagine why they chose that name!) privacy and the law to document ‘probable cause,’ that bare minimum of evidence of a crime, went right out the window. Those Justice and Homeland Security officials know what they’re doing. If they say they need to monitor all phone calls, e-mails, bank accounts and commercial travel, there must be a good reason. And they really don’t need to be bothered with those pesky little rules designed to keep government honest. Honestly, if your banker or grocery store clerk didn’t have any one looking over their shoulders or have to keep a ledger, you could trust them, right?

And since the government’s dealing with all these nefarious types, the likes of which have been around since the beginning of time, like people who decide that they have the right to attack those who never attacked them (Iraq!), then what’s the big deal if we just put them in a prison and not allow them: to know what it is they’re being held for; face their accusers; seek counsel; have their day in court; or even let anyone see, let alone know they’re alive?

Now that we’ve come that far, what’s wrong with letting the government, that body of fellow citizens which generally falls a few degrees south of the moral center, apply a little creative interrogation? After all, how can you expect them to bring the proper charges if they don’t know what the guilty party did? Just because we say we’re going to kill them, murder their wives or rape their daughters, it’s not as if we’re really going to go through with it!

Oh OK, so a few died; what’s the big deal. If they hadn’t been so strong willed they’d probably still be alive. Besides, they were more than likely guilty of something anyway. At least that’s what the CIA said after they destroyed the tapes, that is!

So, here’s my question:

If you were to be approached by any number of our pervasive federal law-enforcement community today, be it FBI, CIA, DHS, NSA, DEA, ATF, IRS, CBP, INS, USMS, SS (Secret Service), EPA (Yeah, they carry guns!), Blackwater (Contractors count too!), etc., and were ‘requested’ to accompany them for reasons stated or not and you believed that you had done nothing to deserve such attention, then what would you do?

Here’s a little something to consider before you answer:

Once in the custody of said supposed law-enforcement officers, you may not be afforded any opportunity to: know what it is you allegedly did or were thinking of doing; be allowed to face your accusers; have legal counsel; permitted a court; or even let anyone in the outside world know that you’re alive. If you’re thinking that the odds of this are so miniscule as to not even rate, then I must inform you that where the odds may be in your favor, a number of fellow citizens whom have done nothing wrong either have suffered this precise fate. Oh, that’s right, I forgot. You probably didn’t hear about most of them because if they talked they would be subject to Part Deux.

The Patriot Act permits the government to threaten and prosecute anyone who divulges anything that may pertain to national security. Well, if you were the agents or Justice (Gulp!) officials who thought they could get away with prosecuting someone just because they looked like a bad guy, you’d invoke national security too. They’re one in the same you know. National Police = National Security!

And here’s the icing on the cake. Once you’ve ‘consented’ to go along with these alleged law-enforcement officials, you have given up any and all rights that you thought you had; because, ignorance of the law is no excuse. If you are a citizen of this nation today, then unless you’ve been living under a rock for the past decade, then there is no plausible rational, let alone excuse, for not knowing what the law of the land is. What with all the press and hype regarding rendition (unlawful kidnapping or extradition), denial of due-process and torture, not to mention, summary executions, or accidental death depending on how you look at it, no citizen today can say that they didn’t know that this could happen to them. This takes us back to my question; which I’ll rephrase.

If you knew that you could lose all rights, to include the right to live, would you willfully, consent to accompany those who are not held to any standard of accountability or law? Would you be willing to subject yourself to strip searches in front of others, to include the opposite sex? Would you give up your right to counsel? Would you give up the most basic of human decency, of being permitted to inform your loved ones of your whereabouts? And quite naturally, your loved ones right to know your whereabouts? Would you agree to being slapped silly for over thirty minutes and slammed into a wall? Would you consent to be placed naked in a cell, have hypothermia induced and be sleep deprived? Would you willfully consent to a mock drowning; which as it turns out, may become your last cognizant experience on this earth? Only for those who subjected you to such inhumane treatment to be afforded all rights and protections, that you were denied? We don’t see any of them being prosecuted now do we?

Or would you stand up as a free man, denounce these perversions of law, and fight for your very life? Here’s a little hint. It’s a trick question.

You see, if you’re waiting for that knock at the door to answer the question, it’s too late. You’ve already given your tacit consent; because while you stood silently when they took away your fellow man, your fellow countrymen even, you made such perversions of law, lawful! By and through the removal of your First Amendment Right, which you have acquiesced to, you gave your tacit (silent) consent to such inhumane treatment by those you entrusted with your very freedoms; namely the federal government. No? Well, when all this came to light, did you write, do or document anything to apprise your government that these horrors were not only done contrary to the Supreme Law of the Land (Constitution), but that you demand that these crimes and criminals be prosecuted? Well? Because if you didn’t, then you did then and do now approve!

Today, that’s the world most Americans have heretofore consented to.

So, the question is: What are you going to do now?

CAN’T STOP THE CIRCUS

Uncontested Facts & Definitions:

Constitution: The fundamental laws and practices that normally govern the operation of a state or association. Webster’s Dictionary

Constitutional Tenet: A constitution applies equally to all those persons subject to it; both as a protection to the individual and a boundary to the sovereign it empowers.

KSM: Khalid Sheik Mohammed: Kuwaiti or Pakistani citizen accused of masterminding the September 11th attacks. By all accounts, KSM was captured in a house in Pakistan in late 2002 or early 2003 by the Pakistani police, in concert with CIA operatives.

War: Armed strife or conflict between nations or states, or between different parties in the same nation. Webster’s Dictionary

The Circus

There is much political bantering today with respect to bringing the September 11th suspects (ie. KSM) to the United States for prosecution. I hear all about how doing so will subject our land to further terrorists’ attacks. There is much ado about how terrorists aren’t eligible for, let alone deserving of, dare I say, justice. And lastly, how such proceedings, given these individuals’ lengthy detention and torture, will give rise to a circus.

Where to start? First off, if you’re afraid that following the rule-of-law will subject us to further attacks, grow a set. Some days I can’t even believe we’re still living in the ‘Land of the Free’ and ‘Home of the Brave.’ The rule-of-law, as laid forth by our Constitution, is not voluntary. The door of justice swings both (equally) ways. If we, in our individual capacity, want the benefit of the rule-of-law, then it must be afforded (applied) equally to all; even to a foreign national suspected of a crime on US soil. As once a probable cause belief has been established that they have perpetrated a crime on or that culminated on sovereign US soil, they are to be tried according to our laws. The only caveat being that if we are unable to capture said suspect alive and they pose a real and credible threat to national security, then the use of deadly force (as in militarily) is authorized. Obviously then, since we didn’t kill these suspects, then they are to be tried according to our laws, in our land.

For all those who argue or parrot the argument that ‘enemy-combatants’ are not eligible for American justice (Law), that prisoners taken from the battlefield are to be tried in military tribunals; get your facts straight. KSM was not taken from any battlefield; unless of course you buy into Bush & Cheney’s re-definition of war. That being that the GWOT (Global War On Terror) is to be fought anywhere on earth. If you subscribe to this assault on Law and the English language then I must inform you that in the eyes of the Law, you just re-wrote all law in this country; because now war can be wherever and whatever those in the government want it to be. Permitting that Bushism, ‘enemy combatant,’ to be assigned to anyone for any number of unilateral reasons; which leads to a police-state where the government can (and now does) invade privacies, take liberties and remove properties, without warrant or benefit of a trial. Say goodbye to your liberties and say hello to your new tyrants!

Now comes the IQ test: Well, you don’t have to worry about that if you’re not doing anything wrong, right? For those who subscribes to this irrational, you fail the IQ test. And how do we know if you’ve done anything wrong or not? Unless you live on Mars, you should know, beyond doubt, that the government is not always correct; that they tend to be prejudicial at times, if not outright fraudulent. How many innocent people have been released from our prisons in this country? How many supposed terrorists have been released from Gitmo?

As for me, I wouldn’t trust this government to walk the dog. Yet many still yell that we don’t need a trial; that we should just lop off these terrorists’ heads. Does the lessons from Bush’s invasion of a sovereign land that had nothing to do with September 11th (Iraq), based on sheer fabrication, escape you? How many lies have we had to endure? How much has this nation lost in blood and monies for the deceits and deceptions of those in the government who can’t seem to find the one man (Osama) they say is behind it all? The law exists for a reason. It exists to protect us from both our foreign enemies and these self-appointed demigods. But when given an opportunity to let the law work, what’s the first thing almost everyone does? Abandon the law! And we wonder why we as a nation are bankrupt; both financially and morally!

So unless you want to live in a society where the truth is whatever the government says it is, regardless of whether it really is or not, then I suggest to you that you want KSM to have his day in court, because if he doesn’t need one then neither do you. Either you trust your government implicitly or you don’t. Take a position and stick with it. It’s one or the other.

And for those two-dimensional types who think this means I’m pro-Obama, pro-socialism, pro-terrorism; go to EnemiesinWar.com, TacitusDominatus.com or read on. As already exhibited, Obama and Holder have about as much intention of upholding the rule-of-law as Bush and whatever his ‘Attorney General of the Week’ did. Not to mention, Holder’s assertion that KSM will get justice (what he deserves) is somewhat alarming. So, we’re to have a kangaroo-court Mr. Holder? Let’s just go through the motions and find the bastards guilty? Does not the truth have a place in all this? Does not the jury, we Americans, have a say?

Speaking of justice, in my humble opinion, here’s what would have been just. Shortly after September 11th, with convincing evidence for all to see in hand, we, as in the United States of America, should have rained down upon Omar and his Taliban compatriots who provided safe-haven to Osama, the Pakistani secret police (ISI) who protected and who no doubt still are protecting Osama, and the Saudi’s who funded Osama, a hellfire storm the like’s of which the world hasn’t seen since World War II. Osama and his band of merry terrorists would have been dispatched with extreme prejudice. Most of those who gave him aid and comfort, not to mention the means to pull off 9~11 would have died right along with him. And then we, the People, should have turned on those traitorous criminals in our own government (Clinton et al., Justice & Customs) who chose to place their profits, their pleasures and their lives above that of those they swore to defend; ie. the victims of September 11th. Now, that’s what I would have called justice; but thanks to those in charge, we are left to deal with and pay for: Iraq, Afghanistan, Gitmo and a never-ending war on us and our rule-of-law. This brings us to the circus.

There is going to be one alright, but just to make sure that full credit for this upcoming debacle is given where it is deserved, let’s take a look at the upcoming program. First and foremost, those in our government who unilaterally decided that these suspects were not subject to the Supreme Law of the Land (Constitution) and took it upon themselves to unilaterally detain without warrant, deny trial and torture them, created what can only be described as a judicial backlash. The only lawful way to go back to the rule-of-law now is to walk back through all the violations of law and Constitution that were so clearly violated in order to get us here in the first place. What are the odds of that? I can only imagine the shenanigans that are taking place in the Department of In-Justice today.

“How do we convict these people who have perpetrated one of the most heinous crimes in our Nation’s history, without indicting those who unlawfully detained, renditioned and tortured them?” ie. George Bush, Dick Cheney, John Ashcroft, et al.

You see, Obama like Bush and Holder just like Ashcroft, Gonzalez & Mukasey, share a common bond. Not one of them wants to uphold the rule-of-law; our Constitution. Because to do so would mean that they themselves could be held accountable; and they don’t want that. They can’t afford that. This Administration (Party), just like the previous Administration (Party), wants to play fast and loose with the Law just like their brethren. That way they can take as many liberties and perpetrate as many frauds as they want without having to worry about some subsequent Administration (Party) holding them accountable. See. It’s party politics as usual. The change is only color; colorable laws, colorable language and the color of the tent.

Yes, with all the political liability and public outcry surrounding this upcoming event it will be nothing short of a circus alright; one where the literary slight-of-hand, the art of misdirection and the bark of political junk-yard dogs, will rule. We’re going to have a front row seat to one of the greatest shows on earth. One in which we get to watch the rule-of-law sacrificed, in order to give the appearance of justice without actually serving justice. I can predict with unwavering certainty: That both political parties will capitalize on this event for their own political gain. Irrespective of law or Constitution, the court and the Justice Dept. will find for whatever is expedient to the finding of guilt; while at the same time, bar any excursions into rendition, intense-interrogations or denial of due-process. And justice itself, will be as fleeting to us as it was to those victims in whose honor these circus-like proceedings will be touted for!

Ref: Petition 08-1230 ~ Enemies in War,

Fellow Americans,
Mr. Gheitner, how is it that our Treasury is bankrupt, but you grant criminals who stole from the Treasury, immunity from prosecution? Ms. Napolitano, why is it your all encompassing “Lexicon” of non-Islamic domestic extremists assigns terrorist overtones to almost every segment of our society, but conveniently omits a category for those federal employees who criminally breach their allegiance to this Nation. Just like those treasonous officials in Homeland Security today (Customs & Border Protection) who instead of protecting our borders pre-September 11th, subjected this Nation to untold terror when they chose to purloin the Treasury instead of protecting said borders. Mr. Holder, where did you read in our Constitution that you are afforded arbitrary and capricious discretion as to which violations of law you will prosecute and which ones you won’t; perpetrated by your own prosecutors no less? Mr. Obama, how on God’s green earth can you expect to maintain any credibility whatsoever by permitting us to be governed by criminals? And no, I’m not talking about the theoretical or inane. I’m talking about those Justice, Treasury & Homeland Security officials who perpetrated those infamous crimes so clearly substantiated in the indictment, Enemies in War. (www.EnemiesinWar.com) That would be the indictment documented in your possession sir.

Solicitor General Elena Kagan, who purports to represent the interest of us, the United States, has essentially stipulated to these crimes by waiving our right to respond to the Supreme Court Petition (08-1230) in this matter. She states “The Government hereby waives its right to file a response to the petition in this case.” The Government? How autonomous! Just like her predecessor, she perpetuates a wall of silence, brought to protect the criminals, as opposed to us. So be it. If you supposed government officials will not enforce the rule of law, then obviously there is no law.

History and Constitution seem to be lost on those of you in The Government today, so let me lay it out for you. The founders of the United States not only declared their independence, but articulated for all time that in order to preserve liberty, it is a citizen’s right and duty, to throw off despotic government; in this case, outright criminal government. I haven’t a clue what the hell you people think you’re doing by withholding our liberties and abusing our powers, but continue to protect these criminals and I will be forced to withhold my consent to whatever you call this unaccountable cabal. Call it what you will, but do not call it the United States government. That is an affront to all Americans and a blatant fraud.

I’ve expended enough years and monies trying to assert my rights and our laws in this criminal matter, so July 4th, 2009 is the deadline for you sworn officials to comply with your end of the bargain. I mean after all, you all took an oath to support and defend the United States Constitution, didn’t you?
